Section 106

 

In 1966, an Act was passed as the nation’s primary historic preservation law.  The National Historic Preservation Act of 1966 requires any project that involves federal funds, licenses or permits that may have an effect on historic properties, to consult with the State Historic Preservation Office (SHPO) in order to assess those effects.  The role of SHPO is to administer Federal and State preservation programs for New York State.  Any approvals, permits, or funding that is given by a federal agency must also be reviewed by SHPO (New York State Office of Parks, Recreation, & Historic Preservation, 2013).

The Special Planned Community Preservation District

The Special Planned Community Preservation District (PC) designation is a New York City Zoning Resolution that preserves and protects the unique character of communities that have been planned and developed as a unit. These communities characteristically have large landscaped park spaces and a superior relationship of buildings, open spaces, commercial uses, and pedestrian and vehicular circulation.

 

The general goals of a Special Planned Community Preservation District are:

  • to preserve and protect the Special Districts as superior examples of town planning or large-scale development

  • to preserve and protect the character and integrity of these unique communities which, by their existing site plan, pedestrian and vehicular circulation system, balance between buildings and open space, harmonious scale of the development, related commercial uses, open space arrangement and landscaping add to the quality of urban life

  • to preserve and protect the variety of neighborhoods and communities that presently exist which contribute greatly to the livability of New York City

  • to maintain and protect the environmental quality that the Special District offers to its residents and the City-at-large; and

  • to guide development within each of the Special Districts that is consistent with the existing character, quality and amenity of the Special Planned Community Preservation District

 

The Special Planned Community Preservation District would protect the unique character of the NYCHA public housing projects that were planned and developed as a unit.  No demolition, new development, enlargement or alteration of landscaping or topography would be permitted in the Special District except by special permit. The special permit would require a Uniform Land Use Review Procedure (ULURP) that would be publicly reviewed and must adhere to a mandated time frame.
